The name was trademarked by a perfume maker and MB got sued. They were required to recall all unsold pens and stop using the names Rouge et Noir and Noir et Noir. It seems they somehow regained the right to use Rouge et Noir since a new model from MB has that name. It's estimated that the pens were on the market for only a few weeks.
