In civil cases spoliation (destruction) of evidence creates a legal presumption that it would be adverse/harmful to the case of the party allowing or causing the destruction.
I’d understand it to be a violation of their duty as a congressman, and an admission that they’d destroyed them. More akin to dodging the question.
